1996<\/strong><\/span><\/span>
\nOrganic Law 5\/1996<\/a>, R<\/span>eforming the Statute of Autonomy of Aragon, in Article 7, states that:\u00a0<\/span><\/a><\/span><\/strong><\/span><\/span>
\n
\n<\/span><\/strong><\/span><\/span>
\nL<\/span>as lenguas y modalidades ling\u00fc\u00edsticas propias de Arag\u00f3n disfrutar\u00e1n de protecci\u00f3n. Se garantizar\u00e1 su ense\u00f1anza y el derecho de los hablantes en la forma que establezca una Ley de las Cortes de Arag\u00f3n para las zonas de utilizaci\u00f3n predominante de aquellas<\/span><\/span><\/em>.\u00a0<\/span><\/span><\/span><\/strong><\/span>
\n
\n<\/span><\/strong><\/span>
\n<\/strong>Aragon’s own l<\/span><\/strong>anguages and linguistic varieties shall enjoy protection. Their teaching, and the right of speakers, will be guaranteed iunder the terms laid down in an Act of the Parliament of Aragon, for the areas where their use is predominant.\u00a0<\/span><\/strong><\/span>

\n<\/strong><\/span><\/span>
\n2005<\/strong><\/span><\/span>
\nOn 21 September 2005 the Council of Europe issued its Report<\/a> – ECRML (2005) 4 – in the initial monitoring cycle, on the application of the European Charter for Regional or Minority Languages in Spain. It included the Recommendation orf the Committee of Ministers. \u00a0<\/span><\/span>
\n
\n<\/span><\/span>
\nThe Committee of Ministers recommended “that the authorities of Spain take account of all the observations of the Committee of Experts and, as a matter of priority … “6. strengthen the protection of Aragonese (“Fabla”) and Catalan in Aragon, inclduding establishing an appropriate legal framework<\/span>” (page 167).<\/span>
\n
\n<\/span>
\nThe Spanish Ministry for Foreign Affairs made the following remark in paragraph R (page 165):\u00a0<\/span>“The government of the Autonomous Community of Aragon has already carried out the necessary prior studies for the forthcoming regulation in a single Act of the different languages spoken in its territory. The great difference between Catalan, a socially well-established language with a solid literary tradition, and Aragonese Fabla<\/em>, with a very limited number of speakers and limited standardisation and literary use, undoubtedly explain why this bill has not yet been passed.<\/span>“<\/span>

\n<\/span>
\n2007<\/strong><\/span><\/p>\n

Organic Law 5\/2007<\/a>, R<\/span>eforming the Statute of Autonomy of Aragon, in Article 7, states that:\u00a0<\/a><\/span><\/span><\/strong><\/span><\/span><\/div>\n

1. Las lenguas y modalidades ling\u00fc\u00edsticas propias de Arag\u00f3n constituyen una de las manifestaciones m\u00e1s destacadas del patrimonio hist\u00f3rico y cultural aragon\u00e9s y un valor social de respeto, convivencia y entendimiento.<\/em><\/span>
\n2. Una ley de Cortes de Arag\u00f3n establecer\u00e1 las zonas de uso predominante de las lenguas y modalidades propias de Arag\u00f3n, regular\u00e1 el r\u00e9gimen jur\u00eddico, los derechos de utilizaci\u00f3n de los hablantes de esos territorios, promover\u00e1 la protecci\u00f3n, recuperaci\u00f3n, ense\u00f1anza, promoci\u00f3n y difusi\u00f3n del patrimonio ling\u00fc\u00edstico de Arag\u00f3n, y favorecer\u00e1, en las zonas de utilizaci\u00f3n predominante, el uso de las lenguas propias en las relaciones de los ciudadanos con las Administraciones P\u00fablicas aragonesas.<\/em><\/span>
\n3. Nadie podr\u00e1 ser discriminado por raz\u00f3n de la lengua.\u00bb<\/em><\/span>

\n<\/span>
\n1. Aragon’s own languages and linguistic varieties are one of the most outstanding manifestations of Aragon’s historica and cultural heritage and a social value of respect, coexistence and understanding.\u00a0<\/span>
\n2. An Act of the Parliament of Aragon will lay down the areas of predominant use of\u00a0Aragon’s own languages and linguistic varieties, will regulate their legal status, the right of the speakers to use them in these areas,\u00a0\u00a0will promote the protection, recovery, teachging, promotion and dissemination of Aragon’s linguistic heritage, and will encourage, in the areas where their use is predominant, the use of Aragon’s own language in citizens’ dealing with Aragon’s public authorities.<\/span>
\n3. No-one shall be discriminated against on the grounds of language.<\/span><\/p>\n

2008<\/strong><\/span><\/span>
\nOn December 11 2008 the Council of Europe issued its Report<\/a> in the 2nd monitoring cycle\u00a0– ECRML (2008) 5 –\u00a0on the application of the European Charter for Regional or Minority Languages in Spain. It included the Recommendation orf the Committee of Ministers\u00a0<\/span>
\n
\n<\/span>
\n The Committee of Experts stated, in paragraph P (page 141) that “Regarding\u00a0Aragonese and Catalan in Aragon, the language law has still not yet been adopted. The lack of a legal framework and of practical measures hampers the promotion and protection of\u00a0Aragonese and Catalan in Aragon.\u00a0The Committee of Experts notes however, that efforts are being carried out in the field of education.<\/span>“<\/span>
\n
\n<\/span>
\nThe Committee of Ministers recommended “that the authorities of Spain take account of all the observations of the Committee of Experts and, as a matter of priority …\u00a0… “5. take steps to adopt a specific legal framework for\u00a0protecting Aragonese and Catalan in Aragon”…<\/span> (page 151).<\/span><\/p>\n

2009<\/strong><\/span><\/span>
\nLaw 10\/2009<\/a>, of 22 December, on the Use, Protection and Promotion of Aragon’s Own Languages. \u00a0<\/span><\/span>Among other things, it lays down the following:<\/span>

 <\/p>\n

\u00a0\u00a01. El castellano es la lengua oficial en Arag\u00f3n. Todos los aragoneses tienen el deber de conocerla y el derecho a usarla.<\/em><\/span><\/div>\n

 <\/p>\n

\u00a0\u00a02. El aragon\u00e9s y el catal\u00e1n son lenguas propias originales e hist\u00f3ricas de nuestra Comunidad Aut\u00f3noma.<\/em><\/span><\/div>\n

\u00a0\u00a03. En calidad de tales, gozar\u00e1n de protecci\u00f3n y se garantizar\u00e1n y favorecer\u00e1n su ense\u00f1anza y el derecho de los hablantes a su uso en las zonas de utilizaci\u00f3n hist\u00f3rica predominante de las mismas, especialmente en relaci\u00f3n con las Administraciones P\u00fablicas.<\/em><\/span><\/div>\n

El procedimiento para declarar los municipios que constituyen las zonas de utilizaci\u00f3n hist\u00f3rica predominante de las lenguas propias se determina en el art\u00edculo 9 de la presente Ley, de acuerdo con criterios socioling\u00fc\u00edsticos e hist\u00f3ricos.<\/em><\/span><\/div>\n

Art\u00edculo 3.-Denominaci\u00f3n de modalidades ling\u00fc\u00edsticas.<\/em><\/strong><\/span><\/div>\n

Los ayuntamientos de las zonas de utilizaci\u00f3n hist\u00f3rica predominante de las lenguas propias de Arag\u00f3n podr\u00e1n, mediante acuerdo adoptado con el voto favorable de la mayor\u00eda absoluta del Pleno, proponer al Consejo Superior de las Lenguas de Arag\u00f3n la denominaci\u00f3n de su modalidad ling\u00fc\u00edstica, fundamentada en razones hist\u00f3ricas, filol\u00f3gicas y socioling\u00fc\u00edsticas.<\/em><\/span><\/div>\n

 <\/p>\n

Art\u00edculo 4.-Derechos ling\u00fc\u00edsticos.<\/strong><\/em><\/span><\/div>\n

 <\/p>\n

1. Se reconocen a los ciudadanos y ciudadanas de Arag\u00f3n los siguientes derechos ling\u00fc\u00edsticos en los supuestos establecidos por la presente Ley:<\/em><\/span><\/div>\n

 <\/p>\n

\u00a0\u00a0 a) Conocer las lenguas propias de Arag\u00f3n.<\/em><\/span><\/div>\n

 <\/p>\n

\u00a0\u00a0 b) Usar oralmente y por escrito las lenguas propias de Arag\u00f3n tanto en las relaciones privadas como en las relaciones con las Administraciones P\u00fablicas.<\/em><\/span><\/div>\n

 <\/p>\n

\u00a0\u00a0 c) Recibir la ense\u00f1anza de las lenguas propias de Arag\u00f3n.<\/em><\/span><\/div>\n

 <\/p>\n

\u00a0\u00a0 d) Recibir, en las lenguas propias de Arag\u00f3n, publicaciones y programaciones de radio, televisi\u00f3n y otros medios de comunicaci\u00f3n social.<\/em><\/span><\/div>\n

 <\/p>\n

\u00a0\u00a0 e) Usar las lenguas propias en la vida econ\u00f3mica y social.<\/em><\/span><\/div>\n

 <\/p>\n

<\/div>\n

2. Nadie podr\u00e1 ser discriminado por raz\u00f3n de la lengua.<\/em><\/span>
\n3. Los poderes p\u00fablicos aragoneses garantizar\u00e1n el ejercicio de estos derechos, a fin de que sean efectivos y reales.<\/em><\/span><\/p>\n

Section 2.-The languages of Aragon.<\/strong><\/span>
\n1. Castilian is the official language of Aragon. All Aragonese have the duty to know and the right to use it.<\/span>
\n2. The Aragonese and Catalan languages themselves are the autonomous community’s own, original and historical languages.<\/span>
\n3. As such, their protection and teaching, and the right of speakers to use them in areas where their use is historically predominant, especially in relation to public authorities, shall be ensured and encouraged.<\/span>
\n4. The procedure for declaring the municipalities in the areas of\u00a0the predominant\u00a0historical use of these languages is laid down in Article 9 of this Act, in accordance with sociolinguistic and historical criteria.<\/span>
\nSection 3.-Designation of linguistic varieties.<\/strong><\/span>
\nThe local councils iin the areas of\u00a0the predominant\u00a0historical use of the languages of Aragon may, by the adoption of an agreement by the affirmative vote of a majority in the plenary, propose to the High Council for Languages of Aragon the name of their own linguistic variety, based on historical, philological and sociolinguistic reasons.<\/span>
\nSection 4.-Language rights.<\/strong><\/span>
\n1. The following language rights are accorded to citizens of Aragon\u00a0in the terms laid down in this Act:<\/span>
\n\u00a0\u00a0 a) To learn\u00a0Aragon’s own languages.<\/span>
\n\u00a0\u00a0 b) To use\u00a0Aragon’s own languages\u00a0orally and in writing, both in private relations and in dealings with the public authorities.<\/span>
\n\u00a0\u00a0 c) To be taught Aragon’s own languages.<\/span>
\n\u00a0\u00a0 d) To receive, in\u00a0Aragon’s own languages, publications and radio, television and other media\u00a0programmes.<\/span>
\n\u00a0\u00a0 e) To use\u00a0Aragon’s own languages\u00a0in economic and social life.<\/span>
\n2. No-one shall be discriminated against on the grounds of language.<\/span>
\n3. The Aragonese government shall guarantee the exercise of these rights, so that they are effective and real.<\/span>

\n<\/span><\/em>
\nEl govern d’Arag\u00f3 ha presentat l’esborrany de l’avantprojecte de llei d’\u00fas, protecci\u00f3 i promoci\u00f3 de les lleng\u00fces pr\u00f2pies de la comunitat, amb qu\u00e8 vol derogar tots els aspectes de l’actual Llei de lleng\u00fces que segons el PP “imposen” la normalitzaci\u00f3 de l’aragon\u00e8s i el catal\u00e0 en aquesta comunitat. L’esborrany deixa de banda la denominaci\u00f3 de catal\u00e0 i parla d'”aragon\u00e8s oriental” per referir-se a la llengua parlada a la Franja de Ponent i fixa l’aprenentatge d’aquesta llengua com a “voluntari”. Amb aquest canvi legislatiu, el govern d’Arag\u00f3 vol evitar que la regulaci\u00f3 de les lleng\u00fces de la comunitat es faci a trav\u00e9s d’organismes de fora d’Arag\u00f3. Tamb\u00e9 preveu la creaci\u00f3 d’una \u00fanica acad\u00e8mia de la llengua.<\/span>\u00a0<\/span><\/em>

\nThe government of Aragon has presented the draft Bill on the use, protection and promotion of the\u00a0community’s own\u00a0languages, with which it wants to repeal all aspects of the current Languages Act which, according to the PP, “impose” the normalization of Aragonese and Catalan in this community. The draft leaves out the name of Catalan and speaks of “<\/span>Eastern\u00a0<\/span>Aragonese” to refer to the language spoken in the “Franja de ponent”, \u00a0and lays down that the learning of the language will be “voluntary.” With this legislative change, the government of Aragon wants to avoid the language being regulated by bodies outside Aragon. It also foresees the creation of a single language academy.<\/span><\/span>
